The public and clients are protected from the negligence of lawyers and their agents. Today, the South Carolina Supreme Court reversed the court of appeals and upheld a trial court decision in a lawyer malpractice action brought by Kahn Law Firm. “[A]n attorney is liable for negligence in tasks he chooses to delegate absent an express limitation of his representation” the Supreme Court held.
The Supreme Court is sending the case back to the trial court for a damages determination.
